The Industrial Relations Court sitting in Blantyre has issued a stay order, stopping Football Association of Malawi (Fam) from paying K440 million to Malawi National Football Team former coach Meck Mwase pending re-hearing from both parties.
The stay order follows a recent court ruling that found Fam to have unlawfully dismissed Mwase from his position two years ago. The court had previously determined that Mwase was entitled to compensation for his lost terminal benefits and bonuses due to the unlawful firing.
Fam’s lawyer Luciano Mickeus of Micklaw and Company confirmed the issuance of the stay order, having appealed the ruling to the IRC.
“The Industrial Relations Court Chairperson Austin Msowoya has finally ordered a stay order against Football Association of Malawi on paying Meck Mwase K440 million pending hearing,” Mickeus said.
On the other hand, Mwase’s lawyer, David Kanyenda of Makiyi, Kanyenda and Associates, said they were prepared to challenge the decision and continue pursuing the case.
Delivering her judgement last month, the-then IRC deputy chairperson Edna Bodole said the amount was for Mwase’s entire 36 months of his contract on the same wage scale as Flames former expatriate coaches Romanian Mario Marinica and Belgian Ronny van Geneugden, who were his successor and predecessor, respectively.
In the ruling, Bodole removed some benefits including motor vehicle allowance, insurance cover, annual gold card membership and life insurance.
